Is texting-and-driving a primary offense?

The State of Oklahoma made texting-and-driving a primary traffic offense when the law was enacted in 2015. This means that a police officer can pull a driver over for texting-and-driving, even if they aren’t doing anything else illegal. The first offense will carry a fine of $100. Additionally, if police determine that a driver is not devoting their full attention to driving, in general, they could be fined another $100. Young drivers who are still in the graduated or probational license program cannot use any devices while behind the wheel. This also includes hands-free options.

More changes coming

Senate Bill 17 has been sent to the House for approval. This pending law would make it illegal for all drivers to use handheld devices in school zones.
